Main information

  • A court in Scotland has mandated that schools provide single-sex toilets.
  • The decision pertains to Earlston Primary School, which has installed gender-neutral toilets.
  • The ruling has significant implications for schools across Scotland.

A court in Scotland ruled that schools must provide single-sex toilets for pupils. The decision came after parents Sean Stratford and Leigh Hurley complained to the Scottish Borders Council.

As highlighted by the BBC, at the newly opened Earlston Primary School, only gender-neutral toilets were installed, which led to dissatisfaction among the parents.

The Edinburgh court ruled that the school has a legal obligation to provide separate toilets for boys and girls. This decision aligns with a recent ruling by the UK Supreme Court, which defines a woman based on biological sex.

Rosie Walker from the Gilson Gray law firm, representing the parents, noted that this case will have far-reaching effects.

The Scottish government reassures that most schools already provide single-sex toilets. However, following the court's decision, all institutions must urgently verify whether they comply with the requirements to separate toilets by gender as specified in the 1967 regulations. Rosie Walker remarked that this decision highlights the importance of protecting gender-based rights.

Comments after the verdict

A school spokesperson admitted that the council accepted the court's decision and does not intend to challenge it. The authorities plan to review the parents' complaint and will respond in due course. It is anticipated that, following the Supreme Court's ruling, updated guidelines regarding school toilets will be issued.
